However, it should be noted that registration alone does not grant a tourist licence nor automatically authorise the commencement of tourism activity. The future exploitation of the property will ultimately depend both on the effective availability of tourism quotas and on full compliance with all legally required conditions.

- Availability depends on previous quota withdrawals

The regulation of holiday rentals in the Balearic Islands is primarily governed by Law 8/2012 on Tourism in the Balearic Islands, together with its subsequent amendments, particularly those introduced by Law 6/2017 of 31 July, amending Law 8/2012 regarding the commercialisation of tourist stays in residential properties, as well as subsequent legislation relating to tourism containment and sustainability measures.
For this reason, before proceeding with any registration, it is essential to assess whether the property meets the conditions required for future tourism use.
An initial review of the property’s cadastral reference allows for a preliminary assessment of its planning status and potential compatibility with tourism use.
In addition, the following aspects should be reviewed, among others:
- The property’s planning classification and urban status
- Compatibility with tourism use
- Applicable territorial and municipal restrictions
- Compliance with the technical requirements established by tourism regulations
Acting Early
Why It Is Important to Act Early
One of the most relevant aspects of the current system is that registration in the temporary quota pools may be carried out without the need to initially acquire tourism quotas, make any payment, or submit certain administrative documentation that will only be required at a later stage.
For example, at this stage it is not yet necessary to submit the DRIAT (Declaration Responsible for the Commencement of Tourism Activity), which is an essential requirement for the lawful commencement of the activity.
The eventual acquisition of tourism quotas will only be offered once availability exists and strictly in accordance with the order of registration of applications, at which point the applicable conditions and corresponding cost will be established.
For this reason, properties that successfully pass the prior legal and planning review may register now and secure a position within the system in anticipation of future quota availability.
